Appeals court sides with users of Chinese drywall | HamptonRoads.com | PilotOnline.com

Victims of Chinese drywall leapt a major hurdle Tuesday when the 5th U.S. Circuit Court of Appeals in New Orleans ruled favorably for seven Hampton Roads families whose homes were ruined by the drywall in the mid-2000s.

A three-judge panel of the 5th Circuit upheld an earlier decision by a federal district judge in Louisiana that the seven be awarded $2.6 million from Taishan Gypsum Co. Ltd., the China-based manufacturer of drywall that poisoned thousands of American homes during the housing boom.

Taishan had appealed the lower-court decision, claiming American courts didn’t have jurisdiction to hear the case.The 5th Circuit’s decision Tuesday affirms that Taishan can be held liable for its products in America.
